In previous years, Employers were required to report compensation paid to Foreign Agricultural workers who entered the country on H-2A visas on Form W-2. However recently the IRS has issued a change stating that H-2A visa workers who do not provide or have a Taxpayer Identification number (TIN), are subject to backup withholding. The employer must now report the wages and backup withholding on Form 1099-Misc http://www.etax1099.com/irs-form-1099/
